Loophole?

Sound like a “Loophole” to you?

A northwest Iowa man faces up to 10 years in prison for selling guns without a license.

Federal prosecutors say in a news release that 62-year-old Tony Hulstein, of Sheldon, was found guilty last week in federal court in Sioux City. Hulstein was convicted of selling firearms without a license and of four counts of traveling in interstate commerce to sell firearms.

Prosecutors say that in less than five years, Hulstein obtained and disposed of more than 800 guns. He had nearly 100 firearms when he was arrested.

Hulstein faces a maximum sentence of 10 years in prison and a $250,000 fine.

Note that there are no charges with selling to prohibited persons.

So much for the “Gun Show Loophole”. Doesn’t seem like much of a “Loophole” if you go to prison for doing it…

    Ouch. I’m no lawyer and the ATF needs to go away, but … 800 in 5 years? That’s pretty clearly into the “commerce” realm in my book.

    It’s an unjust law, but yes he was in the business of selling firearms and that requires an FFL.

    160 guns a year? That’s more than three a week! I know brick and mortar places that don’t sell that many.

    Looks like the ATF is trying to get rid of the competition. I wonder who has more firearms involved in crimes; this guy or the ATF?

    I APPLIED FOR A FEDERAL FIREARMS LICENSE IN 12 / 05 . 1/2006 ATF CAME TO MY HOME FOR AND INTERVIEW AND TOOK MY APPLICATION ALONG. MY APPLICATION WAS FILLED OUT / 200 DOLLARS SENT IN / ZONING WAS COMPLETE / FINGER PRINTS COMPLETE / SHERIFF SIGNED THE APPLICATION / I HAD NO ISSUES FOR GETTING A LICENSE / I HAVE HAD AN INSURANCE LICENSE FOR 32 YEARS NO ISSUES.
    ATF ASKED WHY I APPLIED / I SAID I HAVE A LARGE GUN COLLECTION AND I SELL SOME OFF AND REPLACE / ALWAYS GO THROUGH AN FFL / I WANT TO MAKE SURE I AM OBEYING THE ALL LAWS / THEY ASKED IF I WAS GOING TO HAVE A BUILDING I SAID NO / THEY ASKED IF I WAS GOING TO BE FULL TIME I SAID NO I AM IN THE INSURANCE BUSS / ATF AGENT CHRIS ZUNGARI FILLED OUT THE CANCELATION FORM AND SAID YOU DO NOT NEED AN FFL LICENSE AND MY APPLICATION WAS CANCELED. I DID MY BUYING AND SSELLING THROUGH FFL.
    I HAD A FRIEND IN THE GUN ROOM AT OWATONA MINNESOTA AND I SOLD CABELLAS ALOT OF GUNS .
    THIS IS JUST A SMALL AMOUNT OF INFO BUT YOU CAN GET IT OUT OF YOUR HEAD 800 GUNS IT WAS UNDER 400 GUNS IN 8 YEARS AND THEY TOOK 100 GUNS OUT OF MY COLLECTION SO I THINK UNDER 300 GUNS.
    REMEMBER ONE THING LIEING FOR THESE PEOPLE IS NORMAL.

    hehehe…. if people do things legally, no, they probably dont sell 800 guns in 4 yrs. Doing things illegally, well, prolly sold more than that but didnt get caught. You need a license to sell, even from a private collection. No ATF agent would tell you otherwise. Loose lips sunk your ship. You ran your mouth, threatened witnesses..still got charged and convicted.. Good bye and go to jail…..
