This is how it should be done. I will first add that California’s Open Carry Laws are stupid, and the only people carrying openly are protesting, as a totally unloaded gun has VERY limited uses, even when you have a belt full of loaded magazines.

Still this is an exemplary job. The Officer is friendly, frank, and clear about what he’s doing and why he’s doing it. Also I don’t know my cop-talk, but it appears he’s telling the other officer he doesn’t need any help dealing with this guy. Furthermore the encounter is being video taped and it appears that in California you have no duty to present Identification in such a detainment, and the officer is cool with that, so cool he gives his name and badge number, and states his full understanding that it very well may go up on youtube.

Well played officer Matt Lyons! Now maybe I’m being my usual starry eyed optimist, but maybe if this video goes viral there might be some incentive and understanding by officers exactly how to handle those of us who are exercising our rights, even when you may have some legitimate concerns about how those rights about being exercised.

h/t to Linoge who also points out that Officer Lyons has written a book about his Oceanside Police Department. When he says “This isn’t a 3rd World Country”, he might be speaking honestly about how he uses his badge and legal powers, but that isn’t always true.

    While I appreciate the officer’s behavior during the interaction; I feel compelled to point out a few issues.

    Number one is the fact that based ONLY on the visible possession of a firearm, he felt compelled to seek to identify a person.

    No criminal actions noted, no suspicious behavior, no reports of threats — just a man with a gun was enough to get him to stop a citizen. The entire stop should have concluded after the officer verified it was a legal carry. End of story that is all he needed to know or do.

    Number two, despite confirming that the poster is properly carrying; the officer still seeks additional information. The officer asked for the name of the protester — knowing he didn’t have to identify himself– and then settled for just a first name. How much you wanna bet he would have ran the full name if he could have gotten it.
    The encroachment of our liberties starts exactly that way.

    And third, this video only stands out because how few there are like it. I would bet that even in his own department there are few that would have handled it that way. And those that would, can’t or won’t put pressure on the others to reverse the erosion.

    Apparently, that’s the law in Cali.

    The fact that a person simply has a gun is an indication that a crime is being committed, and it is the obligation on the part of the officer to ensure that one is not. He didn’t feel compelled, he is compelled, at least as their state law is currently written. Google “California Open Carry 12031 Check”.

      WOW, I had no idea about that! that kinda makes me sick to my stomach. Still it is in California. Here in Mass where we need a permit to OWN a gun, any visible ownership seen by a cop comes with a request for your permit for inspection.

      Sorry the “Bearing Arms” part of the constitution is NOT probable cause!

        Dude, I can’t enter your state with a piece of .22 brass stuck in the treads of my shoe without getting tossed in the slammer for a felony; what do you think would happen if I OC’ed there? 😮

          Given that people who haven’t even intentionally OC’d but accidentally exposed their piece (OC with permit is 100% legal here) have had their permit revoked under the discretionary catch-all of “Bad Judgement”. NOBODY dares to here. At least until Alan Gura gets around to swatting these chuckleheads around like the assholes they are!

    Yes, MA is totally nuts. Guns are property, not many things require a license just to own.

    We need to fix that. You can’t buy, sell or own a car unless you have a valid drivers license for that class vehicle.

    I can hear the riot now..

      And you can only sell a car through a licensed auto dealer who wants a cut of the action.

      How many of us have bought or sold a car out of somebody’s backyard or driveway?

    I’m glad there are people out there willing to do this; a different officer could have just as easily pulled out his own gun and ordered him to the ground “for officer safety.”

    Yes, because having a loaded gun pointed at a non-threatening individual with the finger on the trigger is justification for safety.

    It was nice to see the way the officer handled it, however.

      Yep. I have NO idea what the breakdown of good officers to bad ones are….I do know that you only see youtube videos of the REALLY good officers, and the REALLY bad ones, also most people record officer interactions out of fear of mistreatment rather than as a way to catch proper treatment (This guy openly cites “for my own protection” as his reason for filming)

      I do hope this can be a learning experience for officers.
