Remember Those Rules

Both the Four Rules but the rules of self defense:

A Utah man has been arrested after he allegedly fired two shots with a handgun after burglary suspects fled from his house.

Fox13Now.com reports that Clare Niederhauser, of Layton, was driving toward his home Jan. 31 when he saw a car in his driveway and a man standing near his doorway holding a crowbar.

Niederhauser is accused of firing one shot at the fleeing car and another shot after the third suspect fled on foot.

Police say the use of deadly force is allowed when there’s a substantial risk of death or serious bodily injury, and Niederhauser wasn’t threatened by the suspects.

The Utah Castle Doctrine law can be read here. Its Pretty Clear.

The antis claim this is license to murder, yet charges are being filed even tho it appears nobody was hurt in this case. When the attackers flee now its the cop’s job.

This happened about 15 miles south of me, give or take. About half a mile from a coworker.

The cop is present. He is ON SITE. The perp runs. Gets to the back yard and apparently running for an open field… and WHILE THE COP IS STILL THERE, the homeowner pulls off a shot that didn’t hit the bad guy.

    Ugh….

This is the full report on what happened from the homeowner’s POV. He claims that both shots are before the cops arrived.

One of the strictest warnings/cautions I’ve had after “be sure of your target and what is beyond it” is to NEVER fire warning shots. I can understand the frustration of arriving at home to find your house being robbed, but if you want to detain the robbers, he should’ve pulled in right behind them and boxed them in his driveway.
