More Views From the Twilight Zone

Found another article on Minnesota’s Castle Doctrine.

Currently, Minnesota law authorizes the use of deadly force, without an obligation to retreat, when done to prevent the commission of a felony in a person’s home. When not in his or her home, a person can rightfully use deadly force to avert a threat of death or great bodily harm to themselves or another, provided the person first attempts to avoid the danger if reasonably possible. In all situations, Minnesota law properly requires that the response be reasonable and necessary given the gravity of the danger faced.

The proposed changes would eliminate the duty to retreat before exercising the right of self-defense in all locations and permit a person to meet force with superior force, including deadly force, if the individual reasonably believes such force is needed to resist or prevent the imminent infliction of substantial bodily harm, great bodily harm or death. This proposal creates a presumption that deadly force can be used against someone who enters a dwelling by force or stealth, and it expands the definition of dwelling to include decks, porches, fenced-in areas, tents, other structures, and occupied watercraft and motor vehicles.

Sounds pretty good to me. How about you?

Such a law would, in essence, allow people to shoot first and ask questions later whenever they believe they are exposed to substantial harm, regardless of how a reasonable person would have responded under the circumstances. If this proposal were to be enacted, there would be numerous examples of situations where the law would allow an individual to shoot and kill in self-defense, even though a reasonable person would never have done so.

OK first up let’s dive off into the waters of Hollywood. I’m doing this because reasonable people think of self-defense situations, and many of us see things in Hollywood movies that are totally over the top.

Have you EVER seen a scene in a Hollywood movie where the person was asking questions first BEFORE they shot them and had that NOT been murder?

Have you ever imagined such a situation when preparing for a self-defense scenario?

Yeah me neither.

Do we really want to allow a driver who believes he is being threatened with substantial harm in a road-rage incident to shoot and kill the other driver, rather than calling 911 or simply driving away?

Do we really want the law to presume that a homeowner has the right to shoot and kill an unarmed person who has entered a garage to steal a bicycle or other personal property, without first calling the police?

Do we really want to authorize the use of deadly force in response to a push, punch or verbal threat without any inquiry as to whether a reasonable person would have done so under the circumstances?

Hey, you know if I run you off the road with my truck, that could indeed kill you. And you can’t always drive away.

(I think that video may be staged, but its not unrealistic that this COULD happen…do you think the aggressor isn’t justifying lethal force?)

I’ve lived in several houses where the garage is the BEST way in. Some people don’t lock their house door from the Garage, so if you’re in the garage, you’re in the house. Even if the internal door is locked they have a concealed location to force entry.

And if your garage is a separate structure, and you encounter a thief, you may have cornered a criminal. Tell me that’s a safe place to be unarmed!

And from the “Gun Death?” Files I think we can see where punches, shoves can go, and think about what “Verbal Threats” could be. How about “I’m going to kill you mo’fugger!” as they reach into their coat. We obviously need to wait to see if he’s just foolin’ or not, right? That’s totally the smart thing to do.

Oh BTW there’s also an easy way to avoid this: Don’t threaten, attack, or steal things! Don’t do that, and you don’t get shot. Its EASY too, I do it EVERY DAY!

Also by all means call 911, but its wise to back your safety up with a loaded gun.

Still if you CAN think, its pretty obvious this is a good law. If you can’t think, you’re likely anti-gun.

Concessions

One sign that the Antis are dead wrong in everything they do is their exclusive use of in-house “Studies” and statistics. The one exception is when they cook down various valid studies but ONLY judge the metric of “Gun Death”, and I hope my efforts on the “Gun Death?” files has cleared that little refuge of scoundrels out.

Still I was REALLY amused by this little back-and-forth by Joan Peterson. In her latest post she quotes the Kellerman Study, which anybody who’s been in this game for long enough will know is a HORRIBLE study.

Among many flaws the big ones are: A) it makes zero distinctions between guns used by criminals in the commission of crimes, and counts a gang assassination, the proverbial “Drug Deal Gone Wrong”, A woman shooting a stalker or a violent Ex, and family member killing their kin in error as equal data points as the shooter “knew the victim”.
B) Only counts a “Defensive use of a Gun” if a dead body was produced.
c) Only counts the event if it happens INSIDE the home
And the big D) He has never shown his data sets, nor what calculations he did to develop his conclusion. Just in case that wasn’t fishy enough, he’s changed his results numbers (the how many more “times likely” you are alleged to be if you have a gun in your home) several times without explanation.

Oh and of course he was compensated for his work from the Joyce Foundation.

I noticed that you guys haven’t backed off John Lott after he was debunked.

Now I haven’t really boned up on the controversies behind the “More Guns Less Crime” study. I will say I know that Dr. Lott does claim to have lost the original data set in a computer crash, and he was involved in a controversy involving a sockpuppet (something VERY common with the Antis, I may add)

The reason I don’t know much about this is because I hear controversy about Dr. Lott’s work, so I stopped citing it in debates. I’ll add that I’ve met Dr. Lott and I first introduced myself to him as “A Huge Fan!”, but as great as he is, we don’t NEED him. Arthur Kellerman is the ONLY person to produce a study that says that a gun in the home is more dangerous than a home without a gun.

Meanwhile Dr. Lott is NOT the only Dog in town to find that Crime decreases as gun ownership increases, and even at best studies show that gun control is more-or-less irrelevant in factors of crime.

The NRA has conducted a bunch of studies on guns…I ignore them. The NRA is a massive portion of the 2nd Amendment Lobby, weather the study is valid or not, the ethics of using a gun lobby study about guns just brings too much to question.

Still while the antis HAVE raised QUESTIONS about Dr. Lott’s work, they have not proven him wrong. Nowhere do you find any studies that say that as lawful guns increase in an area, violent crime increasing.

Well at least studies not paid to say exactly that.

He links this picture. A clean-cut guy in business casual (tho thems are some nice shoes, maybe he puts on the coat and tie when he gets to the office) having a coffee and reading his paper, with his GLOCK and SERPA in tow. What’s the big deal? Nobody else in the shop appears to notice or care. (As a general rule if people are afraid or intimidated they tend to keep their eyes on the threat, and avoid getting cornered. Seems like everybody else in the shop is having a good time, and enjoying their coffee. Might have a bit of an irrational fear…or being paid to propagate one, in the case of CSGV.

Shoot First bill will be heard in Minnesota Senate this week. We don’t need a law to make it easier to shoot innocent people.

First up, this is straight-up propaganda, so let’s inject some facts.

It’s commonly known as the Castle Doctrine, Bill 1467 states: An individual taking defensive action may use all force and means, including deadly force. It presumes a person using deadly force has reasonable belief that imminent harm exists. The bill also redefines a “dwelling” to include front and back yards as well as motor vehicles.

Shoot an innocent person that’s called “Murder” and its still on the books, and still reads the same. Somebody forces entry into your home or car, or makes violent threats while trespassing on your property you can assume they mean it. I also assume that after a shooting if no criminal charges are filed against the person defending their lives this further protects them from civil suits against vengeful families of the criminals.

Just goes to show that anti-rights advocates are also pro-criminals, if these are the people they’re calling “Innocent”.

“Gun Death” Argument

They say “Gun Death” is a valid metric because with guns arguments can turn deadly.

A 48-year-old Akron man was charged Thursday with the murder of his 72-year-old mother who was found stabbed to death Wednesday night in her home.

Daniel Smelko, of Highview Avenue, was charged with murder and committed to the Summit County Jail. Police said Pat Sees was killed following an argument with her son at the Highview Avenue home.

Its not the tool its the person behind it.

Its hilarious because I doubt Starbucks marketing and treasury have any idea how today ranks up compared to other days, and of course how does NGVAC know the sales for the day?

All I could think was: “When Will the Coffee Lobby Stop Hiding Their Sales Numbers!!!!”

Day Went Bust For Me

Looks like a ton of you have shared your Starbucks experience with me! Awesome.

I just didn’t feel well enough to leave the house. Hopefully after a good night’s rest I’ll be back to my normal self.

Because of this barring any objections I’ll be visiting Starbucks after work tomorrow getting myself a coffee (whatever they call the “Big” size there) and taking my picture Wednesday evening.

Then I’ll email the post URL to Starbucks so it reaches the ears that can make the biggest difference.

BTW I did take a few moments to read the twitter streams of the antis. While today we’re showing our support for Starbucks, its kinda hard to show your boycott…especially when the people who support you don’t actually shop there in the first place.
