Gotta love them beating the drum even when it makes no sense. Joan is over at her blog talking about the Boston Bombers. Not about them making a bomb…because only “Gun Death” matters to her, but about how they had a gun.
Commenter Chris notes that they didn’t have an Massachusetts LTC, so they couldn’t buy a handgun, as GCA 68 makes that a crime. Joan Responds:
So apparently Chris, you are ignoring the fact that private sellers at gun shows and other venues sell guns to just about anybody with no background checks and sometimes no IDs. If they ask for no ID, they have no idea whether someone is a resident of their state. This is happening all over the country.
First up, I doubt many gun sales between strangers happens without at least the exchange of ID, its so easy people don’t even think about the depths of the ramifications. It’s a crime to sell a gun to a minor or a handgun to somebody under 21 (in most states), and it is illegal to privately sell firearms across state lines.
With no ID exchanged you’d need to make a pretty good argument to why you thought you knew this person well enough to know they were of age and a state resident to avoid federal prosecution. (That is, if we ever prosecuted people on this crime, that’s another story)
Meanwhile people who don’t care about the law don’t care….exhibit A (PDF), in Massachusetts you CANNOT posses, or exchange a firearm without an FID or LTC. The ID must be shown, and with a sale the transaction must be registered with the state.
Why do all those guns seized trace back to Massachusetts????

Are there sellers that do that? Sure. Do they deserve to be in jail when they sell to Tommy Crackhead. Yep.
But Joan can’t differentiate between that individual jackass and the majority of firearm owners. She needs to believe that we’re all soulless, heartless monsters that giggle when we see dead children. It’s the only way she can maintain her perverted worldview.
Yep, if you DON’T ask for ID from a stranger in a private sale you are ASKING for trouble. Of course, again, none of these cases are actually prosecuted, as most of the crime guns are stolen property traded between prohibited people, and those transfer charges are quickly plead away as the bigger crimes are more of an interest to the courts.
Also she sees us as heartless, soulless monsters who don’t care about dead children….but we wouldn’t so much as Jay-Walk if a law was passed.
I don’t think it even makes sense to her…it just is in her sick mind.
It is ‘theoretically’ possible I have been involved with a couple of transactions where the seller didn’t ask for my ID.
Of course, in those ‘hypothetical’ transactions the seller might have been a member of the same private range that I belong to……so there are times when it isn’t asking for trouble 🙂
I think depending on how your club inducts members, this could be as good as knowing the person well.
There are times when there are factors that let you know 100% something.
So Joan thinks the answer to sellers not following law and common sense is to pass another law?!?!
Of course all this is speculation at this time since no one knows how they obtained that firearm.
More importantly Joan shows her bigotry by not focusing on the bombs which killed and injured the most people but the firearm ! The killers used fireworks (talk about a mature and replicable technology), cooking vessels and toys to do the most damage. Yet instead of focusing on what could save the most lives (not letting radicalized Muslim extremists back in the country after being warned) — Joan flogs the dead horse of background checks.
And she calls for gun owners to have mental health checks?????
I hate to break it to her, but the most common form of ID (driver’s license) lists the state right there on it, and with only a few exceptions you have to legally be a resident of that state to get one. In fact, there’s an irritating amount of paperwork involved.
So, if someone hands you a XX state DL, you can be reasonably certain they are a resident of XX. If XX is not the state you are in, you can’t sell them a gun.
But, it’s Joan. Facts and logic need not apply.
And, of course, these same liberals tend to LOVE the idea of issuing driver’s licenses to illegal aliens. . . or simply not bothering to check whether someone is a citizen or legal resident before issuing the licence. . . at the same time they register them to vote. Yet, for most people, a driver’s license is the only form of government ID they possess.
Interesting how she makes it about the seller and the gun, and not the criminal trying to buy a gun they shouldn’t have.

If legal private sellers behave the way she says they do, “all over the country,” they are inviting problems. Who willingly does that?
But it can’t be the criminal’s fault they bought a gun illegally. It’s not like the criminal solicited the sale, or anything. It’s not the criminal’s fault he didn’t get a background check or get the required permit or buy a gun with an obliterated serial number (assuming he didn’t do that himself); it can’t be. In her mind, gun sellers have to be criminals who haven’t been caught yet, like drug pushers – “First one’s free,” and all that – else all her arguments fall apart. Occam’s Razor is a concept lost on her.
Now, where’s MY free first gun!? 😉
I HAS to be guns and lawful gun owners. Not only has the ban on criminals been laughably inneffective, but Joan likes how they vote, so they can’t be ALL bad!
I’ll bet she’s against Voter ID laws, too, because they “disenfranchise the poor and minorities” (and criminals), and would be willing to demolish the voter registry (you DO have to “register” to be a voter). We don’t need a voter registry to exercise your right to vote!
But background checks, requiring ID, and registries are just peachy for guns and gun owners exercising THEIR rights. How’s about a little consistency?
Oh, right: those voters agree with her, and gun owners don’t, so we need to restrict the latter’s rights and liberalize the former’s. Vote early, vote often, and vote multiple times, even after you’re dead; it’s the Chicago (read: liberal) way!
This is one of the greatest “Progressive” disconnects. Remember we need crazy background checks across the boards, because criminals and the mentally ill (not to mention “Terrorists”) are buying guns in private sales….minus of course any evidence of this actually happening.
Meanwhile voter fraud NEVER happens, and nobody would ever vote when they are not allowed to do, or vote more than once….despite crazy cases like in the Franken re-count, as well as simple looks at voting in college towns where many of the warm bodies in the area aren’t actually FROM that state.
