Now I don’t have an issue with cops checking him out, but “Disorderly Conduct”? Bullshit ticket.

PS: The reporter is one of those people who I have absolutely no idea what her ethnicity is. Is “Nineveh Dinha” an ethnic name I’m unfamiliar with, or is it some bizzaro new-agey name invented by illiterates?

    It’s pretty obvious why they gave him the ticket, if you’ve been around cops much. They don’t like wasting time and not having something to show for it, so they came up with a bullshit ticket so that they could justify their time that they wasted. I’ve seen this sort of stuff before, so I’m not surprised.

      Yeah “Disorderly Conduct” is like “Public Drunkeness” or “Dunk and Disorderly”.

      Anybody walking down a street with bars late at night will see drunks being drunk walking right past cops. Cops don’t care. When you do something the cops DO care about they drop charges they can level for “Crimes” that aren’t.

    The reporter might be a child of some Iranian or Iraqi Immigrates who have LEGALLY entered the country over the last few decades. Wouldn’t sweat it.

    As for the Ticket: EASY PEASY! 2 hours of Police Time “checking him out” means SOMEONE has to pay for the Cops Time. Boss Hog don’t like no money coming in for that much time. He’ll probably beat the Rap, but he won’t get reimbursed for Court Costs, Lawyers Fees, etc.

    This happened in Utah? I thought people there had more sense than to call the cops just because some guy is putting a couple of rifles into his car. Of course, when a-stalking I will go, I always load a pallet in my vehicle first. . .

      This state has been invaded by Californians for years; they come here and do nothing but bitch about how things were better back home, and do their best to Caliform the place. I wouldn’t be surprised if the woman was from somewhere else.

        Yeah, that was my first thought, Bob. She ain’t local, I’m pretty certain. Something tells me this ticket will be summarily dismissed by a judge. Also, the state Legislature is working to redefine the Disorderly Conduct and Trespass statutes to prevent this very nonsense.

        Also, Nineveh is apparently an absolute sweetheart, from the reports I’ve heard.

  7. Let’s explore “disorderly conduct.”

    76-9-102. Disorderly conduct.
    (1) A person is guilty of disorderly conduct if:
    (a) he refuses to comply with the lawful order of the police to move from a public place, or knowingly creates a hazardous or physically offensive condition, by any act which serves no legitimate purpose; or
    (b) intending to cause public inconvenience, annoyance, or alarm, or recklessly creating a risk thereof, he:
    (i) engages in fighting or in violent, tumultuous, or threatening behavior;
    (ii) makes unreasonable noises in a public place;
    (iii) makes unreasonable noises in a private place which can be heard in a public place; or
    (iv) obstructs vehicular or pedestrian traffic.
    (2) “Public place,” for the purpose of this section, means any place to which the public or a substantial group of the public has access and includes but is not limited to streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops.
    (3) Disorderly conduct is a class C misdemeanor if the offense continues after a request by a person to desist. Otherwise it is an infraction.

    Clearly he did not fit category (b) as he did not fight or engage in violent, tumultuous, or threatening behavior. He did not make unreasonable noises anywhere, and he didn’t obstruct vehicular or pedestrian traffic. Even if he did, they would have to prove he intended to cause public inconvenience, annoyance, or alarm, or the risk thereof. So no dice on section(b)

    So it’s category (a) they are shooting for. The question is, did the police lawfully order him to move? Probably not. He moved himself to a church parking lot, which is presumably private property. So all they have on him is the allegation that he knowingly created a hazardous or physically offensive condition by any act which serves no legitimate purpose.

    This means at trial they will have to prove three things. First they will have to prove that there was a hazardous or physically offensive condition. Second, they will have to prove that HE created it. And third, they will have to prove that the act which created it served no legitimate purpose. I don’t even think they can prove the first part, much less the third.

    We’ve been looking at the same thing over on the UCC forums and the charges HAVE been dropped. I still hope the guys goes after them.

    We have HB49 in the house right now that clarifies the law saying that barring extra circumstances, the mere possession of a firearm by a lawful carrier CANNOT be grounds for Disorderly Conduct.
